Welcome to GigHub! These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and GigHub ("we," "us" or "our"), concerning your access to and use of our application and website. You agree that by accessing the application, you have read, understood, and agreed to be bound by all of these Terms of Service.
1. Intellectual Property Rights
Unless otherwise indicated, the application is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the application (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.
2. User Representations
By using the application, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Service; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the application through automated or non-human means, whether through a bot, script or otherwise; and (6) your use of the application will not violate any applicable law or regulation.
3. User Registration
You may be required to register with the application. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
4. Prohibited Activities
You may not access or use the application for any purpose other than that for which we make the application available. The application may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
As a user of the application, you agree not to:
- Systematically retrieve data or other content from the application to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
- Make any unauthorized use of the application, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
- Circumvent, disable, or otherwise interfere with security-related features of the application.
- Interfere with, disrupt, or create an undue burden on the application or the networks or services connected to the application.
- Use the application as part of any effort to compete with us or otherwise use the application and/or the Content for any revenue-generating endeavor or commercial enterprise.
5. Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the application at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our application. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the application.
6. Governing Law
These Terms shall be governed by and defined following the laws of the jurisdiction in which GigHub operates. GigHub and yourself irrevocably consent that the courts of that jurisdiction shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
